I am neither a copyright lawyer nor a judge. I’m sure both have detailed and technical answers such as there are different legal frameworks around fair use and they apply differently to AI training versus direct reproduction. But suspend, if you will, all those technicalities for a moment.
Is it simply that Eight Mile Style, Eminem’s publishing company, could crush me for quoting Eminem in a book because I am small in comparison, or that Meta could drown Eight Mile Style, which is equally small in comparison, in teams of lawyers and years of delay? (I should note that Eight Mile Style has filed its own copyright infringement lawsuit against Meta, in which it alleges “another case of a trillion (with a ‘T’) dollar company exploiting the creative efforts of musical artists for the obscene monetary benefit of its executives and shareholders without a licence and without regard to the rights of the owners of the intellectual property”. Hear, hear.I’m writing a book and can’t quote a single line from a song. So how can big tech legally feast on all the lyrics ever written? asks Guardian Europe columnist Alexander HurstCue that line from the National as a perfect stage-setting epigraph – though only in theory. Song lyrics, my publisher informs me, are subject to notoriously strict copyright enforcement and the cost to buy the rights is often astronomical.I imagine that a copyright expert would tell me that what ChatGPT did is akin to me scribbling lines from the National or Eminem in a personal notebook; that if I ever recorded and sold this AI-generated song quoting either one directly, then I would be guilty of infringing on protected material.
Again, I'm not any kind of lawyer, and I'm definitely not offering legal advice, but yeah, I'm not buying this argument. I'd argue that a truly transformative, creative synthesis requires at least some understanding of whatever material you're imbibing.
The UK's Data (Use and Access) Bill has now passed, without the amendment that would've required AI tools to declare the use of copyrighted material, or any provision for copyright holders to 'opt-out' of their work being used as training data. The whole thing has left me wondering if there'll ever be something that AI can't gobble up and regurgitate.A federal judge has ruled that Anthropic didn't break the law when it used copyrighted material to train the large language model Claude, as this counts as "fair use" under US copyright law, reports AP News. What's keeping Anthropic submerged in legal hot water, though, is how the company may have acquired that copyrighted material—in this case, thousands of books not bought but 'found' online. The full complaint goes on to read, "An essential component of Anthropic’s business model—and its flagship 'Claude' family of large language models (or 'LLMs')—is the largescale theft of copyrighted works," and that the company “seeks to profit from strip-mining the human expression and ingenuity behind each one of those works.”As such, the ruling made by San Francisco federal court Judge William Alsup on Monday means that Claude can keep being trained on the author's works—but Anthropic must return to court in December to be tried based on the whole "largescale theft of copyrighted works" thing.

In a motion related to Perlmutter's lawsuit, though, she alleges that sending out the registrations without a signature opens them up to “challenges in litigation,” something outside copyright experts have also pointed out. “It’s true the law doesn’t explicitly require a signature,” IP lawyer Rachael Dickson says.“Litigators who are trying to challenge a copyright registration’s validity will jump on this.” · Perlmutter’s lawyers have argued that leaving the Copyright Office without an active boss will cause dysfunction beyond the registration certificate issue, as the Register performs a variety of tasks, from advising Congress on copyright to recertifying organizations like the Mechanical Licensing Collective, the nonprofit in charge of administering royalties for streaming and download music in the United States.During a wild time for copyright law, the US Copyright Office has no one at the helm—and no one knows when that will change. It’s a tumultuous time for copyright in the United States, with dozens of potentially economy-shaking AI copyright lawsuits winding through the courts. A US court has ruled Anthropic was not breaching copyright rules when it trained its AI model on books.
A lawyer for the authors declined to comment.A US judge has ruled that using books to train artificial intelligence (AI) software is not a violation of US copyright law.Anthropic, a firm backed by Amazon and Google's parent company, Alphabet, could face up to $150,000 in damages per copyrighted work.
The judge said that one "potentially winning argument" — that AI tools could harm the market for human-created content — was barely mentioned.
A group of authors had sued Meta, saying their copyrighted books were used to train its AI models. The judge said the plaintiffs' lawyers failed to make the right arguments.Instead, the judge said the lawyers for the other side botched the case. A California federal judge on Wednesday dismissed most of a lawsuit brought by a group of authors who accused Meta of using their copyrighted books to train its AI models."This ruling does not stand for the proposition that Meta's use of copyrighted materials to train its language models is lawful," Chhabria said. "It stands only for the proposition that these plaintiffs made the wrong arguments and failed to develop a record in support of the right one." Chhabria said that one "potentially winning argument" — that AI tools could harm the market for human-created content — was barely mentioned. The lawyers representing the authors presented no evidence about how Meta's models could generate outputs that would "dilute the market" for their works, he said.Judge William Alsup of the Northern District of California ruled that Anthropic's use of millions of copyrighted books to train its AI models was "exceedingly transformative" and qualified as fair use, a legal doctrine that allows certain uses of copyrighted works without the copyright owner's permission.

The 108-page report was a “pre-publication” version, which means it wasn’t yet finalized. It is not customary for the US Copyright Office to release this type of document, according to copyright lawyer Aaron Moss.
“The president has as much legal power to fire the Register of Copyrights as I do, which is to say: none,” Meredith Rose, legal counsel for intellectual property nonprofit Public Knowledge, said in a statement. The document the two men cited also stated that deputy attorney general Todd Blanche, who previously served as a personal defense lawyer for Trump, was now the acting Librarian of Congress. The two men appeared at the US Copyright Office days after the Trump administration fired its leader, who had just published a report about the use of copyrighted materials for AI training. Two men claiming to be newly appointed Trump administration officials tried to enter the US Copyright Office in Washington, DC, on Monday, but left before gaining access to the building, sources tell WIRED. Their appearance comes days after the White House fired the director of the copyright office, Shira Perlmutter, who had held the job since 2020.Perlmutter was removed from her post on Saturday, one day after the agency released a report that raised concerns about the legality in certain cases of using copyrighted materials to train artificial intelligence.
John Strand, a copyright lawyer at the US law firm Wolf Greenfield, said the decision from a “well-respected” judge was “very significant”.
Judge says firm made ‘fair use’ of literature but storage of pirated books in central library constituted infringementAlsup added, however, that Anthropic’s copying and storage of more than 7m pirated books in a central library infringed the authors’ copyrights and was not fair use – although the company later bought “millions” of print books as well. The copyright issue has pitted AI firms against publishers and the creative industries because generative AI models – the term for technology that underpins powerful tools such as the ChatGPT chatbot – have to be trained on a vast amount of publicly available data in order to generate their responses. An Anthropic spokesperson said the company was pleased the court recognised its AI training was transformative and “consistent with copyright’s purpose in enabling creativity and fostering scientific progress”.
